Illinois Foreclosure? Don’t Panic!
In Illinois, you can not be forced from your home unless your lender (or loan servicer) first sues you for foreclosure, wins the court case, causes your home to be sold at auction, has the judge approve the sale and orders you to move. With minimal participation on your part, the entire court foreclosure process generally takes at least seven months and frequently longer. Okay, take a deep breath! You may have defenses to the foreclosure case, counterclaims against the lender or servicer, or an opportunity to negotiate or mediate a solution to keep your home or to more effectively cut your losses. Among your rights as a homeowner are the right of “reinstatement” and the right of “redemption.” These are different methods for paying for and keeping your home, with different requirements and time frames.
